IT may not be as riveting a read as the Australian Law Journal but Australian judges could do worse than dip into a recent edition of al-Qa'ida's online training manual. The magazine, Al-Battar Military Camp, ranks Australia the fourth most important Christian terrorist target behind those other infidels, the US, Britain and Spain.

And it is ironic that while some judges draw on the views of five friends in a caf to alter our laws according to community standards, others fail to take judicial notice of the blindingly obvious.

Judges, take note: terrorism is part of our lives. While defendants such as Khazal and Jamal are entitled to the presumption of innocence, the community is also entitled to be kept safe. If judges fail to recalibrate how they exercise their discretion on matters such as sentences and bail to take account of the devastating consequences of terrorism, then parliament may do so for them.
