With or without an indictment against Rove, the Court could still have imposed immunity on him so he would not take the 5th in the Libby case.
Since Fitz was just in court on June 12th and Luskin's announcement came on June 13th, one day after Fitz was in court, telling Judge Walton who he planned to call to testify, Luskin's announcement could very well be as a result of that hearing and the imminent testimony of rove. Fitz could have filed some interrogatories for Rove to answer under oath in 15 days.
We'll know what the subject of the June 12th hearing was when Fitz updates his website and incloudes his pleadings and exhibits for all to read for themself.
