Rimone, Noise and Chris, you guys may need to help me out. Blogger changed to Google accounts and it won't let me make a new post. I haven't found the right way to hold my mouth in the help subjects yet, but maybe there's a workaround. I was going to make a post about the Iran war and some others, if you want to discuss the news. I sure hope Luke gets back before Bush blows us to smithereens, I'd hate for him to miss it.

Chris, we're all Lukery's friends but virtual ones online. my site's Dateline: Bristol but i quit posting on politics a few months back (lol, apart from my 4 Schadenfreude posts the day after the last elections, Schadenfreude which i'm still savouring. i've now turned my site into a virtual journal and place for my poetry and stories and stuff. you can find my political ravings by clicking on categories like 'amerika' and 'bend over and take it' in upper right column. btw, i was just over at yours--very nice.

A different Kathleen told me this last week that 'friends don't let friends use AOL,' so I'm trying to put that into practice and encourage Kax to mend her ways.

Heya everybody, just droppin in to say hello from Good Ole (crappy!) Memphis Tennessee. I start my old job back (for those of you who care, i really really really liked it)! so YAY for me, sorry, had to do a little self gloating. I have an idea (don't everyone gasp at once :-D ), but I cannot get any of my other "politico" friends to actually go along with me one it. My idea is to start a blog where all of us (I am formally inviting all the readers (especially the very loyal...i.e. the one's that tip him off on stories) to join in on this project if it seem worthy: Starting a Seperate Blog, with me and the outher "Founding" Fathers (and Mothers ladies, don't kill me) as administratiors, and we all become editors of different areas (i.e. International Editor, Editorial Editor, etc), and the Editors would act as a council in place of an Editor in Chief, voting on various editorial issues. I figure with all of our readers combined, we'd have a decent starting readership. Each Editor could get another person(s) to help them with their areas, and we could even have "Editorial Death Matches" where, when our collective genius fails to agree, two editors could deul it out on the editorial page. If no one here is very good at HTML/webpage building, me, along with a very good friend of mine who is a web design college professor could easily make a webpage. Geez, here is my long-winded-ness, nwo what the hell do any of ya need to mail me for, it seems I told you ever bit of my idea (it must be the ramblings of a person who may be under the influence of an un-named substance :-) PEACE DUDE).

As for the rest of the folks here, it sounds like the wheels of justice are not far from landing on the likes of Dusty Foggo and Brent Wilkes. In addition to Carol Lam looking to get the indictments out before she leaves office next week, just a few minutes ago, AP just put out this piece presenting in more detail the stuff that Foggo and Wilkes are in trouble for.

My guess is that indictments could come out any time now!

Interesting article from today's NC Times on delays in the San Diego cases against folks like Mitch Wade, Brent Wilkes, Dusty Foggo, etc.

Though I don't care for a lot of things that Rahm Emanuel did as the chair of the DCCC, he seems to have just played a pretty nice card on Gonzales on the whole question of Carol Lam's outing. It looks like he's found a way to weave around their complaints of her not being effective with the immigration cases as the reason for her firing by saying that she should be named as an outside counsel in the Cunningham case.

Hah! It will be hard for them to rationalize that she wouldn't be good for that role, since she has been successful at prosecuting corruption cases so far and arguably should at least continue the one she's been prosecuting for continuity sake. Since another newer attorney will be responsible for the immigration cases they so vehemently complain about, there will be no excuse in that corner to get rid of her if she's working in this role. I'd like to hear Gonzales' response to this suggestion!

Note also that both Anna Nicole Smith and Sibel Edmonds appealed their cases to the Supreme Court around the same time in 2005, and guess who got their case heard by them then!

And note that Anna Nicole Smith just died a short time ago. Sibel, STAY SAFE!

I've read it LeeB, but there are others arguing that it represents a bad outcome for Watada. The reasoning seems to be that civil rules don't apply in military tribunals and that simply re prosecuting the case would see the military win. I know the military manual requires service personnel to refuse illegal orders but the issue seems to be whether an individual officer has the authority to make an individual determination on the legality of any particular war. I'd like to hear any detailed views on this, if anyone has any.

I'm not so sure that civilian rules don't apply in this case. According to what I have read in the trial coverage here in the local papers, court martial decisions are subject to review within the military and an appeal process that leads, step by step, out of the military and into the federal court system, then on up through the appellate courts. That, it seems to me, is a hint that federal court rules may well apply. Ultimately, it all goes back to the Constitution, which was invoked as the basis for the outrage expressed by Seitz to Judge Head upon his denial of several fact and expert witnesses. I persist in the belief that after 20+ years of experience in cases of this type, Eric Seitz is probably very familiar with the rules in "the manual" as well as how the Constitution applies.

Marjorie Cohn was one of the expert witnesses Judge Head would not allow to testify. She has a piece posted at BuzzFlash, Marjorie Cohn: Watada Beats the Government. The piece includes what she would have said if allowed to testify.

For background, Marjorie Cohn is a professor at Thomas Jefferson School of Law (San Diego), a criminal defense attorney, and president of the National Lawyers Guild. She is also one of the group responsible for bringing the war crimes case against Rumsfeld in Germany.

I think it is becoming increasingly obvious that the bu$h regime would sure-as-hell like this case to simply disappear. A non-practicing J.D. pal of mine is firmly of the opinion that this judge may even have been ordered to stop this trial by any means necessary because of the way it was going. She thought that had the mistrial not been declared, Ehren would have won an acquittal. With the prosecution overheard muttering that their own expert was "a disaster," she might well be right.

One news report also said that a re-trial could not happen before May because of a scheduling conflict. A lot can happen between now and May.

And don't forget: This is all happening while across the country, the closely-related trial of Scooter Libby continues. Stay tooned.

"Watada maintained that his refusal to participate in an illegal war in Iraq was justified, indeed required, under the Army's own Uniform Code of Military Justice. Under Judge Head's rulings, however, there simply would be no way for a soldier to resist an illegal order. Indeed, an American military person could be ordered to commit mass murder or genocide and then be denied the right even to make a case for the lawfulness of his actions. The judge's rulings fly in the face of the Supreme Court's Hamdan v. Rumsfeld decision, which stood for the principle that all US officials are bound by national and international law not to commit war crimes."

Thanks Leeb. Your thoughts are appreciated. I reasoned along similar lines, just without your details. I'm also thinking its a win for Watada. I had been a little bit confused by some bloggers elsewhere who were arguing with passion that Watada was in a bad legal position and his lawyer had failed him. Like you, I'm not buying it. Thanks again.

There's also this. It really looks like the judge was so fixated on his original (wrong) ruling not to admit the illegal war argument that he felt compelled to follow his logic in rejecting the agreed stipulation. It would appear to be prima facie bad for the prosecution - in terms of double jeopardy and a retrial attempt -if they request a mistrial over a defence objection. The logic would be that such a process would be discouraged at law for the simple reason that it would encourage prosecutors to sabotage cases not going well for them in the hope of a retrial. Looks like a win for Watada.

...I seem to recall one report that Watada's service term expires in March or May. They may just let him leave.

The judge blew it afaics.

Thanks for the link, Damien. The more I read, the more I agree with you that the judge blew it. But I also think that had he NOT blown it, the likelihood of an acquittal was pretty good. So now we wait to see how long it will take the gov't to throw in the towel altogether.

WeazelsRevenge always has some interesting articles and this one is about a Feb 11 report in the Murdoch owned Aussie press that talks about Iran having 'suicide drones' - planes without pilots - that are supposedly available to attack US naval craft in the Gulf region. The article does not seem to have been taken up by the US media which is interesting in itself. But the source for the 'news' item was an Iranian agency called Mehr which is a California based group of Iranian expatriates seeking to overturn the current government. Da Weez cites some articles from their website: "Why is the Islamic Regime still alive?, The Role of Smart Sanction in Fight against the Islamic Regime, "Third Option”, Regime Change by Iranians, Islamic Regime of Iran must not be supported and welcomed to the world community, Petition to urge the World Bank not to Recognize the Islamic Regime as the Representative of Iranian People and stop awarding it with Loans, Do not Recognize the Islamic Regime as the Representative of Iranian People."

Ok, so it's propaganda. But it could provide useful 'evidence' should any US naval craft come to grief in the Gulf. Remember the Maine?

thanks to everyone for keeping the place afloat (well, not everything, oldschool's car apparently doesn't float)

the main part of my trip is over - i flew back into melbourne today - am doing a side trip for a few days, and then perhaps another side trip for a day - but will be back in the saddle at the start of next week.

at first glance, it looks like good-ish news re watada, and amazing news re foggo/wilkes etc - can't wait to read that story.

Well for those of us who had hoped that Carol Lam might have been retained to follow up on the Foggo/Wilkes indictments and other cases going here, it doesn't look like that's going to happen now, as it looks like she just took what looks to be a big job at Qualcomm. Wonder if the Bush admin had anything to do with that "being available" for her!
